Privacy Policy

Speaktionary Learning Inc. is responsible for personal information under its control, including information processed by service providers on our behalf. Privacy questions and requests may be directed to the Privacy Officer, Speaktionary Learning Inc., info@speaktionary.ca.

We collect only information reasonably required to operate the Service. Depending on how you use Speaktionary, this may include the categories below.

• Adult account information: name, email address, account credentials or authentication identifiers, verification status and basic account settings.
• Subscription information: selected plan, trial status, subscription status, renewal/cancellation status and payment-related metadata provided by our payment processor. We collect payment information, but Speaktionary does not store full payment-card numbers, which are stored and processed by our Payment Processor as described in our Terms.
• Support and feedback information: messages sent through contact/support forms, word reports, correction requests and correspondence with Speaktionary.
• Technical information: IP address, browser/device information, session and security logs, error information and essential cookie/local-storage identifiers used to operate the Service.
• Speech/pronunciation information: if the microphone feature is used, the browser/device speech-recognition service may process microphone audio to return recognized text or a pronunciation result. Speaktionary is designed not to intentionally store raw microphone audio. We may store the resulting activity outcome (for example, completion or score) as part of learning progress.

We use your information, including personal information, to provide, administer and improve our Service. For example, we may use your information to:

• Create, verify, authenticate and secure your accounts.
• Provide vocabulary, pronunciation, quiz, curriculum, progress and related learning functionality.
• Administer the subscriptions, entitlements, cancellations and account status.
• Provide customer service, password resets, service notices and other account communications.
• Diagnose errors, maintain reliability, prevent misuse and protect the security of Speaktionary.
• Maintain account-level learning progress so a user can continue where they left off.
• Comply with legal, accounting, security and regulatory obligations.
• Send marketing or promotional electronic messages only where permitted and with the appropriate consent; marketing consent is separate from acceptance of the Terms.

We may also use aggregated and anonymized information which no longer identifies any individual. We may use this anonymized information to improve and develop the Service, research learning trends and prepare statistical reports, and we may share it with third parties.

Because Speaktionary is designed for use by Learners, the Account Holder is responsible for authorizing and supervising Learner use. Where meaningful consent must be provided on behalf of a Learner, the Account Holder represents and warrants that they are the parent/guardian or otherwise authorized to provide that consent.

When a Learner chooses a microphone-based pronunciation feature, microphone audio may be processed by the browser, device platform or speech-recognition provider to recognize the spoken word. Currently, Speaktionary uses browser-based speech recognition, and such information may be processed outside of Canada.

Speaktionary does not retain raw voice recordings. The speech provider may process and retain information under its own terms and technical architecture. If you do not wish for speech recognition and related information to be processed, you may use a non-microphone option where available (for example, typing or continuing without voice).

Depending on the browser, recognition may be performed on the browser maker’s servers rather than on the device (for example, Google for Chrome, Apple for Safari, Microsoft for Edge).

We may share your information with third-party service providers who help us operate Speaktionary. For example, we share information with third-party service providers who help us with:

• application hosting, authentication, application data and related platform services;
• subscription and payment processing. Payment information is collected and processed by our third-party payment processors pursuant to the terms and conditions of their privacy policies and terms of use. Our current payment processor is Stripe. You can read about Stripe’s privacy practices by following this link: https://stripe.com/en-ca/privacy;
• email delivery providers for account/service messages;
• browser/device speech-recognition for microphone-based pronunciation recognition; and
• other infrastructure, security, monitoring, analytics or content-delivery providers needed to operate the Service.

If we are involved in a merger, acquisition or sale of all or a portion of our assets, we may transfer your personal information as part of that transaction.

We do not sell personal information to advertisers. We may disclose information to service providers acting on our behalf, where required by law, to protect rights or security, or as part of a business transaction subject to appropriate safeguards.

Some of our service providers may store or process information outside Canada, including in the United States or other jurisdictions. Information processed outside Canada may be subject to the laws and lawful-access rules of those jurisdictions. Speaktionary remains responsible for personal information under its control and uses contractual, technical and organizational safeguards appropriate to the sensitivity of the information.

Speaktionary may use essential cookies and browser storage for authentication, session continuity, security, preferences, entitlement state and core functionality.

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, to support account reactivation, to meet legal/accounting obligations, to resolve disputes and to protect the Service.

Ending a trial or cancelling a subscription does not automatically delete the account or learning progress. An Account Holder may contact info@speaktionary.ca to request account deletion, subject to information we must retain for legal, fraud-prevention, accounting or security reasons.

We keep a minimal record that an email address has already used the free trial, so that deleting and recreating an account does not start a second trial.

Speaktionary uses administrative, technical and organizational safeguards appropriate to the sensitivity of the information. However, no method of electronic transmission or service is 100% secure, and we cannot guarantee that unauthorized access, hacking, data loss or breaches of our security systems will never occur. Accordingly, you should not transmit personal information to us using our Service if you consider that information to be sensitive.

Payment card details are entered on Stripe’s secure payment page and handled by Stripe, a PCI DSS Level 1 certified provider. Speaktionary does not store full credit card numbers.

Subject to applicable law, an Account Holder may request access to personal information Speaktionary holds about them, request correction of inaccurate information, withdraw consent where consent is the legal basis (subject to legal/contractual limits), or ask questions about privacy practices. Requests to receive a copy of your information or to withdraw consent may be sent to info@speaktionary.ca with the subject line “Privacy Request”. We may need to verify identity before fulfilling a request.

We may update this Privacy Policy from time to time. If a change is material, we will provide appropriate notice and obtain fresh consent where required. The change will be effective as of its effective date, which will be specified in the notice or will otherwise be revised on this Privacy Policy. By continuing to use the Service on or after the effective date of the change, you agree to be bound by the revised Privacy Policy.

13.1 Essential browser technologies

Speaktionary may use cookies, local storage, session storage or comparable browser technologies that are necessary to authenticate users, maintain sessions, remember language/preferences, enforce trial/subscription entitlements, preserve security state and support core app functionality. Disabling essential browser storage may prevent parts of the Service from working.

Some learning state is also kept on your device so the app responds quickly: for example, sight words marked as learned, a count of words looked up and a cache of spoken-word audio. This stays in your browser and is not sent to us.

13.2 Analytics and marketing technologies

Speaktionary or our third-party advertising providers may also use cookies, pixels and other technologies to keep track of your browser so that you will be recognized when you visit other websites where our third-party advertising providers may show you advertisements from us based on your visit to our Service. You can opt out of these interest-based advertising campaigns by turning off cookies in your browser. If you opt out of interest-based advertising, you may still see advertisements from us on other websites. However, they will not be customized based on your browsing history on our Service.
